This is a courtesy translation, provided so that English-speaking users can understand the document. The Portuguese version is the legally binding one: if anything here diverges from the Portuguese text, the Portuguese text prevails.
Welcome to Plare. These Terms of Use (“Terms”) are an agreement between you and Plare BIM Inc. (“Plare”, “we”) and govern the use of the plare.app website and the Plare desktop application (together, the “Platform”).
1. Acceptance
By accessing the Platform, creating an account or taking part in the Closed Beta, you state that you have read, understood and accepted these Terms. If you do not agree with any provision, do not use the Platform.
2. Who may use it
- You must be at least 18 years old and have full legal capacity.
- If you use the Platform on behalf of a company, you state that you have the authority to bind that company to these Terms.
- Use is intended for professionals and students in architecture, engineering and related fields.
3. Account and security
To access certain features you create an account with an email address and a password. You are responsible for:
- keeping your password confidential and not sharing it;
- using a strong password used only on the Platform;
- telling us immediately about any unauthorised use of your account;
- keeping your registration details up to date.
We are not liable for losses arising from unauthorised access caused by negligence in safekeeping your credentials.
4. Licence to use
We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the Plare application and to access the Platform, exclusively for your professional or academic work.
This licence does not permit you to:
- copy, modify or distribute the application;
- reverse engineer, decompile or extract the source code, except where expressly permitted by law;
- resell, rent, sublicense or transfer access to third parties;
- remove proprietary notices or trademarks.
5. Closed Beta
Access to Plare is currently granted by invitation, within the Closed Beta programme. By taking part, you acknowledge that:
- the software is under development and may contain bugs, instability and incomplete features;
- features may change, be replaced or be discontinued without prior notice;
- there is no guarantee of continuous availability or of compatibility between versions during the Beta;
- projects created in the Beta should be exported periodically (DWG/IFC) as a safety measure;
- your feedback is very welcome and may be used freely to improve the product, with no obligation of compensation.
We strongly recommend not using Beta versions as the only documentation for construction work in progress.
6. Plans and payments
During the Closed Beta, access is free. When paid plans launch, we will announce the commercial terms in advance, and they will apply from the moment of purchase or renewal, as applicable.
Prices, billing cycles, refund policy and cancellation terms will be published before any charge is made. No charge will be made without prior authorisation.
7. Intellectual property
What is yours: you retain full ownership of the projects, drawings, models and files you create on the Platform. We claim no rights over your content, and we do not use it to train models or for any purpose other than providing the service.
What is ours: the application, the code, the brand, the visual identity, the text on this site and the blog content belong to Plare or its licensors and are protected by intellectual property law.
8. Acceptable use
When using the Platform, you agree not to:
- break any law, third-party rights or these Terms;
- attempt to gain unauthorised access to accounts, systems or data;
- interfere with how the Platform works, including through automated means of overload;
- transmit viruses, malware or illegal, offensive or defamatory content;
- use the Platform to develop a competing product by reverse engineering our software.
9. Availability
We aim to keep the Platform available, but we do not guarantee uninterrupted operation. We may suspend the service temporarily for maintenance, updates or technical and security reasons, without this giving rise to any right to compensation.
10. Limitation of liability
To the maximum extent permitted by law:
- the Platform is provided “as is”, without warranties that it will meet all your needs or that it will run without interruption or error;
- we are not liable for indirect damages, lost profits, loss of data or loss of opportunities arising from the use of, or inability to use, the Platform;
- during the Beta our liability is even more limited, given the experimental nature of the product;
- nothing in these Terms excludes liability that cannot be excluded by law, including under the Brazilian Consumer Defence Code, where applicable.
Keeping backups of your projects is your responsibility.
11. Suspension and termination
We may suspend or end your access, with or without prior notice, in the event of a breach of these Terms, misuse, a risk to the security of the Platform or a legal requirement. You may close your account at any time by requesting deletion at [email protected].
12. Privacy
How we handle your personal data is described in our Privacy Policy, which forms part of these Terms.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. For the resolution of disputes, the courts of the user’s domicile are elected where the user is considered a consumer under applicable law; in all other cases, the courts of the district where Plare is headquartered.
14. Changes to these Terms
We may update these Terms to reflect changes in the product or in legislation. Relevant changes will be communicated by email or by a notice on the Platform. Continued use after a change constitutes acceptance of the new version.
